State Disability Discrimination Laws

There are myriad federal, state, and local laws related to disability discrimination. While some of them are similar to the Americans with Disabilities Act (ADA), employment discrimination laws and compliance requirements differ by state and can be very specific.

Reasonable accommodations for people with disabilities

The ADA requires employers to make reasonable accommodations for the known physical and mental limitations of employees and applicants with disabilities who are qualified for job positions – unless the accommodation creates an undue hardship for the employer.

Like the ADA, most states have their own disability discrimination laws that require employers to provide reasonable accommodations. However, some states define disability differently than federal labor and employment law and require different accommodations.

Complying with state disability laws

In some cases, more than one disability discrimination law applies to the same situation. When that happens, employers must be careful that their workplace policies and employment decisions comply with all applicable laws. State law is superseded by federal law only when there is a direct conflict, which is rare in disability discrimination law.
